Thank you for your interest in Redwood Credit Union’s Lower Lake Truck Drawing. By entering the Lower Lake Truck Drawing, you hereby agree to adhere to the following terms and conditions in these Official Rules (“Official Rules”).

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.

Some restrictions may apply. Drawing void where prohibited. Drawing is subject to all applicable federal, state, and local laws and regulations.

The Lower Lake Truck Drawing (“Drawing”) is active from 12:00 a.m. PT on July 5, 2022, until 11:59 p.m. PT on January 21, 2023 (“Drawing Period”). Drawing is sponsored by Redwood Credit Union (“RCU” or “Sponsor”). You understand that you are providing your information solely to RCU.

Terms. In these Official Rules, the following terms shall apply:

• “Drawing” refers to the “Lower Lake Truck Drawing” sweepstakes.
• “Official Rules” refer to these terms and conditions.
• “RCU” and “Sponsor” refers to Redwood Credit Union.
• “You”, “Your”, “Member”, and “Entrant” refer to the persons entering this contest.

Eligibility. The Drawing is open to RCU Members in good standing (as defined in the Membership Account Disclosure) who are legal residents of Lake County, California, and at least eighteen (18) years of age as of the beginning of the Drawing Period. Officers, directors, and employees of the Sponsor, or its affiliates or subsidiaries, and their immediate family members (including spouses, parents, children, siblings, and their respective spouses), regardless of where they live, are not eligible to participate.

How to Enter. You will automatically receive one (1) entry into the Drawing upon completing any of the following actions during the Drawing Period:

• Becoming a new Member of RCU,
• Refinancing an existing loan from another financial institution (eligible Entrants will be automatically entered as of date of credit application submission, which must occur within the Drawing Period),
• Obtaining a new loan or credit card from RCU (eligible Entrants will be automatically entered as of date of credit application submission, which must occur within the Drawing Period),
• Referring a new Member to RCU (new member must apply for membership within the Drawing Period and clearly identify the referring Entrant),
• Contacting and engaging with RCU’s affiliate, RCU Insurance Services, for information related to an insurance quote or insurance related information,
• Contacting and engaging with RCU’s affiliate, RCU Auto Services, for information related to a vehicle purchase, a test drive, or other dealership related information, or

You may also enter by clearly printing your name, address, email address and phone number on a 3”x5” or larger index card or piece of paper with the words “LOWER LAKE TRUCK DRAWING” and mailing it to Redwood Credit Union at PO Box 6104, Santa Rosa, CA 95406, Attn: Lower Lake Truck Drawing (entries from eligible Entrants must be postmarked within the Drawing Period).

Limit one (1) entry per person per day, regardless of entry method. Participants must enter to win by 11:59 p.m. on January 21, 2023.

Prizes. Ten (10) invitations to participate as a finalist in a Live Grand Prize Event will be awarded with an estimated value of $0.00. In addition to the invitation, each finalist will also receive a prize of RCU branded promotional materials with an estimated value of $10.00. One (1) Grand Prize will be awarded at the Live Grand Prize Event to one (1) of the ten (10) finalists. The Grand Prize consists of a pre-owned 2020 Toyota Tacoma 4WD SR5 Double Cab 6’ Bed V6 truck with an estimated value of forty-four thousand and ninety-two dollars ($44,092.00). Sponsor reserves the right to substitute a comparable prize of equal or greater value in its sole discretion. The Grand Prize vehicle will also include RCU Auto Services’ ninety (90) day, four thousand (4,000) mile warranty. The total value of the Grand Prize is estimated to be forty-five thousand dollars ($45,000.00), including vehicle tax and license fees paid by RCU on the winner’s behalf. Winner is solely responsible for any income tax consequences as a result of accepting the Grand Prize. Prize is non-transferable. Prize has no equivalent cash value and may not be exchanged for cash.

PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED, BY SPONSOR, EXCEPT AS EXPRESSLY SET FORTH IN THE RCU AUTO SERVICES NINETY (90) DAY FOUR THOUSAND (4,000) MILE WARRANTY AWARDED AS PART OF THE GRAND PRIZE.

Method of Selection. For the first-round drawing, ten (10) finalists will be selected by random drawing at 12:00 p.m. on January 23, 2023, at RCU to receive an invitation to participate in the Live Grand Prize Event. Each finalist will be invited to participate in a Live Grand Prize Event at the Lower Lake Branch at 11:00 a.m. on February 5, 2023 (“Live Event”). Finalists need not be present at the first-round drawing to receive an invitation to participate in the Live Event but must respond within forty-eight (48) hours after notice is given to remain eligible (see Notification). Selection as a finalist, and/or the invitation to participate as a finalist in the Live Event, is non-transferable.

A finalist must be present at the Live Event to participate in the Grand Prize drawing and win the Grand Prize. If a finalist is unable to attend the Live Event, the finalist forfeits their status as a finalist and the opportunity to participate in the Grand Prize drawing. At the Live Event, all finalists will have their name put into a receptacle and a winner will be drawn randomly from the ten (10) finalists. Winner must be present at the Live Event to win and take possession of the vehicle. THE TIME OF THE LIVE EVENT IS SUBJECT TO CHANGE. IF THE WINNER OF THE GRAND PRIZE AT THE LIVE EVENT IS DISQUALIFIED, SPONSOR RESERVES THE RIGHT TO DETERMINE AN ALTERNATE GRAND PRIZE WINNER BY CONDUCTING A RANDOM DRAWING FROM THE REMAINING QUALIFIED FINALISTS.

Odds of Winning. Odds of winning depend on the number of eligible Entrants at the time of the first-round drawing but are estimated at approximately 1:500.

Notification. Finalists will be notified by January 24, 2023, by email (and/or telephone, if available) of their selection in the first-round drawing as a finalist and the information related to the Live Event. Finalists must respond within forty-eight (48) hours after notice is given to confirm their acceptance of the invitation to the Live Event. In the event a finalist does not respond within forty-eight (48) hours after notice is given, RCU will choose another finalist at random, and the previous finalist will forfeit all rights associated with the Grand Prize Drawing. Grand Prize Winner will receive additional information regarding warranty, and any additional information related to the Grand Prize via email after the Live Event.

LIMITATION OF LIABILITY AND RELEASE. SPONSOR ASSUMES NO RESPONSIBILITY FOR TECHNICAL FAILURES OF ANY KIND, OR FOR ENTRIES THAT ARE STOLEN, MISDIRECTED, INCOMPLETE, DELAYED BY COMPUTER TRANSMISSIONS OR MAIL/POSTAGE, LOST, LATE, MISDIRECTED, ILLEGIBLE, OR MUTILATED. SPONSOR IS ALSO NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY ENTRANT, WEBSITE USERS OR BY ANY OF THE EQUIPMENT OR PROGRAMING ASSOCIATED WITH OR UTILIZED IN THE DRAWING OR BY ANY TECHNICAL OR HUMAN ERROR THAT MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE DRAWING. SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY, OR SUSPEND THE DRAWING. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE DRAWING OR LIVE EVENT WILL BE DISQUALIFIED AND INELIGIBLE TO PARTICIPATE OR CLAIM A PRIZE, AND MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SHOULD SPONSOR CHOOSE NOT TO ENFORCE ANY TERM OF THESE OFFICIAL RULES, IT SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.

Publicity and Release. You understand and agree that by entering into this Drawing, RCU may use and/or publish your name, voice, picture, likeness, and biographical data, and/or any other information contained in your Drawing entry. RCU may use and/or publish this information in advertising, promotional, and marketing materials without any additional compensation to you. Such publication may include disclosure of your information in print, television, radio, cable, internet broadcast, and/or any other form of media. In addition, by entering, you hereby consent to being photographed, filmed, taped, and/or interviewed about the Drawing. You hereby grant full permission and consent to RCU to use any of the results of such photography, filming, taping, and/or interviewing in any and all media now known or later devised and release RCU from any and all liability related to such publication.

You hereby release, hold harmless, and indemnify RCU employees, officers, directors, affiliates, agents, contractors, successors, coaches, and consultants, from any and all liability resulting from RCU’s use of any information obtained through your participation in this Drawing. This release includes any claim that personally identifying information or likenesses, recordings, or images of any kind created or obtained because of the participation in this Drawing, has been intentionally or negligently misused, that Entrant has been defamed, or that Entrant’s right of privacy has been invaded.

Finalists and Grand Prize Winner may be required to complete, sign, and submit an affidavit of eligibility/liability release/publicity release (“Affidavit”). If an Affidavit is not properly executed or if a potential Winner does not otherwise comply with these Official Rules, his/her prize will be forfeited. If any potential prize Winner is found to be ineligible or declines a prize for any reason prior to award, such potential winner may be disqualified. If a winner does not complete and submit the Affidavit, if required, at the time of prize pick-up, their prize may (in Sponsor’s sole discretion) be forfeited.

Governing Law. These Official Rules are subject to all applicable California, federal, and local laws. To the extent any portion of these Official Rules is found to be unenforceable or in violation of any such laws, that portion shall be deemed null and void, and the remainder shall remain in full force and effect.

Miscellaneous. Eligibility to participate as a finalist, and any prize, is non-transferable. No person not selected by Sponsor as a finalist may be substituted for any other finalist, and no prize may be substituted or redeemed for cash, except at the Sponsor’s sole and independent discretion. All decisions of Sponsor with respect to the Drawing and/or the interpretation of these Official Rules are final.

Tax Implications. A 1099-NEC will be provided to the Winner for appropriate tax reporting purposes. Payment of any and all federal, state, and local taxes, and the reporting consequences thereof, are the sole responsibility of the Winner. For tax reporting implications, please consult with a tax adviser.

Insurance and Operation. Grand Prize Winner is responsible for purchasing all legally required insurance for the Grand Prize vehicle and for complying with applicable California insurance standards. RCU is not responsible for purchasing insurance for the Grand Prize vehicle. Winner is also responsible for compliance with all laws applicable to the ownership, use and operation of the Grand Prize vehicle. Grand Prize Winner is responsible to ensure that either Grand Prize Winner, or a person acting on Grand Prize Winner’s behalf, is present at the Live Event with a valid unexpired driver license and legally required minimum insurance coverage in order to take immediate possession of the Grand Prize vehicle once necessary titling paperwork is completed.

DMV Title. After the Live Event, the Grand Prize Winner agrees to execute all necessary California Department of Motor Vehicles (DMV) titling paperwork to ensure DMV title can be transferred to the Winner. RCU will assist the Winner with the DMV process and provide the Winner with a new registration card and stickers once available. Winner will not be responsible for registration fees or sales tax for the vehicle. If there are any difficulties associated with DMV titling, the Winner agrees to work with RCU to ensure the proper transfer of vehicle ownership.

Right to Cancel or Modify. At RCU’s sole and independent discretion, RCU reserves the right to cancel or modify any aspect of the Drawing or Live Event, including the prize, dates of events, and timelines associated with the Drawing. Any changes to these Official Rules will be promptly posted at www.redwoodcu.org/LakeCountyTruck. In the event of fraud or technical problems and the integrity of the Drawing is questioned, RCU may, in its sole discretion, take whatever lawful actions it deems appropriate to ensure the integrity of the Drawing and Live Event.

Additional Terms & Conditions. RCU reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Drawing should any virus, bug, non-authorized human intervention, fraud, or other cause beyond RCU’s control corrupt or affect the administration, security, fairness, or proper conduct of the Drawing. In such case, RCU may select the finalist(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by RCU to address the issue. RCU reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Drawing or Live Event, or any RCU website, interferes with the administration, security, fairness, or integrity of any aspect of the Drawing or Live Event, or violates any part of these Official Rules. RCU has the right, in its sole and independent discretion, to maintain the integrity of the Drawing, to void entries for any lawful reason, including, but not limited to, multiple entries from the same Entrant in excess of the Drawing rules. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Drawing or Live Event may be a violation of criminal and civil laws. Should such an attempt be made, RCU reserves the right to seek damages to the fullest extent permitted by the law.

Privacy and Use of Your Personal Information. Except as prohibited by law, by entering the Drawing or accepting any prize, each Entrant agrees to allow Sponsor to contact him/her using any information provided by Entrant to RCU, including by email or mobile telephone, and to use his or her name and likeness for any and all permissible purposes, including marketing, without compensation.

INDEMNIFICATION/LIMITATION OF LIABILITY. ENTRANT AGREES THAT REDWOOD CREDIT UNION, AND THEIR SUBSIDIARIES AND AFFILIATES, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS (“INDEMNIFIED PARTIES”) SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY CLAIMS, INJURIES, LOSSES OR DAMAGES OF ANY KIND RESULTING FROM: (A) ENTRANT’S PARTICIPATION IN THIS DRAWING OR LIVE EVENT; (B) SPONSOR’S USE OF THE ENTRY IN ACCORDANCE WITH THESE OFFICIAL RULES; (C) DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE DRAWING OR EVENT; OR (D) IF AWARDED THE GRAND PRIZE, ENTRANT’S ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. ACCORDINGLY, ENTRANT HEREBY AGREES TO RELEASE, INDEMNIFY AND HOLD HARMLESS THE INDEMNIFIED PARTIES, AND EACH OF THEM, FROM AND AGAINST SAME. SPONSOR MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THIS DRAWING OR THE GRAND PRIZE, EXCEPT AS EXPRESSLY STATED IN THESE OFFICIAL RULES, AND SPECIFICALLY DISCLAIMS ALL SUCH WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES FOR MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR ANY PARTICULAR PURPOSE.

COVID Protocols. Entrants understand that California Department of Public Health (CDPH) and Lake County COVID protocols will be followed at the Live Event and county guidance for facial coverings and other sanitation practices will be enforced pursuant to CDPH and Lake County guidance.
